Our terms and conditions are here to help you understand both our responsibilities to you and also what we expect from you. If you have any specific concerns, comments or worries please contact us and we will try to help.
DEPOSITS
Any booking over 28 days prior to the training date may be confirmed by payment of deposit of at least 30% of the total amount. The full balance is required at the latest 14 days prior to training day.
BOOKINGS
To book a place on one of our courses/ sessions you are required to complete and return our booking form. This will be deemed as a provisional booking and will be held for 7 days. If payment is not received within 7 days, Lymington Sea School reserves the right to re-book without any liability. Once payment is received the booking will be confirmed by Lymington Sea School by e-mail. No liability will be accepted by Lymington Sea School as a result of a late confirmation.
REFUNDS

More than 14 days prior to the training date: full refund.

14 to 10 days prior to the training date: 50% refund

Less than 10 days prior to training date: no refund.
MEDICAL
Clients with special medical conditions should check that their GP considers them safe to participate and advise Lymington Sea School of any such condition when booking. Necessary medication should be brought with you. Please note this experience is not suitable for anyone suffering from back, knee or neck problems. If you are unsure whether this trip is suitable please contact us.
VESSEL
If Lymington Sea School changes vessels due to any vessel becoming unavailable for any reason, this in no way affects the validity of the booking or the terms and conditions stated herein which remain.
OWN BOAT TUITION
Tuition is provided on your boat on the following basis:

The vessel is insured by the owner for loss, damage and legal liability to third parties.

The owner remains the skipper and legally responsible for the safe management of the vessel at all times (including when under tuition) and will not hold the Instructor responsible for any loss or damage.
The owner undertakes to secure the consent of the insurers to this agreement.
DISCLAIMER
No Liability is accepted for any clients, vehicles or properties whilst parked at the marina. No liability is accepted for clients whilst on Lymington Sea School’s premises, property, pontoons or vessels other than respective death or personal injury caused directly by the negligence of Lymington Sea School. All clients take part in any training at their own risk.
SAFETY
All members of training parties are required to wear life jackets throughout the entire duration of the training while aboard the vessels. Smoking on the company’s vessels is strictly forbidden and alcohol may only be consumed in moderation and further only at the discretion of the skipper or other employee or agent of Lymington Sea School. The ultimate decision regarding the safety of the vessel and those on board, rest with the skipper. Lymington Sea School or the skipper may refuse to carry any passenger, or property for any cause relating to the safety of the vessel. In such circumstances the passenger and /or person training the vessel shall not be entitled to any compensation or payment whatsoever.
ALTERATIONS
Lymington Sea School reserves the right to alter the scheduled training in any way they consider desirable due to adverse weather or any other conditions. They also reserve the right to alter prices in accordance with any major changes in cost, which may occur between the time of booking and the time of departure.
INSURANCE AND LIABILITY
Lymington Sea School carries a full marine insurance for bodily injury or accident to passengers onboard to a limit of £2m for any one accident. Lymington Sea School’s insurance does not cover any member of the training group away from the vessel, engaged in water sports or other activities. Lymington Sea School shall not accept any liability for loss, damage, personal injury or death whatsoever sustained by any training group or passenger, other than in the case of proven negligence of Lymington Sea School or its crew. Lymington Sea School accepts no responsibility for any losses or additional expense due to delays in air, road, rail, sea or other services due to strikes, war, weather or other causes.
COURSES
All courses require you to reach a certain standard at which the relevant certificate can be awarded. Certificates can only be awarded to those reaching that standard however if for whatever reason further time is required to reach the standard we will create a plan to help you achieve the award.
